GLENN HEIGHTS – The City of Glenn Heights has released the signed Chapter 380 Economic Development Agreement for the Glenn Heights Data Center with AMF Mission Critical LLC, making the fully executed agreement available for public review.

One of the most discussed aspects of the project during recent Glenn Heights City Council meetings has been the agreement’s potential $15 million economic development incentive.
According to the signed agreement, the City Council authorized economic development grants of up to $15 million. The agreement provides that qualifying grant payments would be calculated annually based on 50% of the city property taxes collected from the eligible property, subject to the agreement’s terms and conditions, until the maximum grant amount is reached or the agreement otherwise expires.
The agreement also describes several conditions related to the project before grant payments become available, including a stated minimum capital investment of $250 million, completion of specified project improvements, certain public infrastructure improvements, and other contractual requirements outlined in the agreement.
Questions Remain As The Project Moves Forward
During a recent City Council meeting, the developer discussed changes to the project’s initial construction plans.
Glenn Heights Future has not identified a publicly approved amendment to the Chapter 380 agreement reflecting those discussions.
The agreement describes the incentive package approved by the City Council but does not address every question residents may have regarding future changes to the project. The release of the signed agreement gives residents the opportunity to review the contract approved by the City Council and compare its terms with future developments as the project moves forward.
Among the questions residents may have are:
- How will the city determine when the agreement’s contractual requirements have been satisfied?
- How do the project’s current plans compare with the agreement approved by the City Council in 2024?
- If the project changes further in the future, will any amendments to the agreement be considered by the City Council?
Those questions may be addressed as development continues and additional public information becomes available.
The release of the signed agreement also provides additional context to the public discussion surrounding the project’s proposed incentives. While the agreement authorizes economic development grants of up to $15 million, it also outlines the conditions, milestones, and documentation described in the contract before qualifying grant payments may occur.
For now, the signed agreement provides the most complete public record of the incentive package approved by the City Council.
